Commercial Disputes
Commercial Disputes:
- Advising a client in the Printing industry in respect of a contractual dispute with a Finance company over the enforceability of the contract against the Finance company after the company our client outsourced their printing to went into administration.
- Representing a Construction company in respect of a claim against them for negligent design and construction
- Successfully defending a claim by the franchisor against the franchisee, our client, in the Domestic/Commercial cleaning industry
IT & E-commerce
- Successfully representing a client in respect of a dispute with their website provider after our clients website was removed from the server, resulting is substantial losses for the client.
Commercial Risk Management
- Drafting bespoke Terms and Conditions for a client who had recently incorporated a new company to ensure its particular industry requirements were met.
Property Litigation
- Successfully obtaining, on behalf of the owners of a retail/industrial estate, an emergency order evicting trespassers from their land.
- Representing a client in respect of a dispute over use of a right of way. tbi made an application to the court for a Declaration that our clients were entitled to use the right of way for all purposes. The Judge ruled in favour of our clients which allowed them to press ahead with their development plans.
Debt Collection and Recovery
- A client was owed £25,275.27 which had been outstanding for some months. After we sent one Letter Before Action, the debtor contacted the client and agreed a repayment plan and the debt was paid in full.
- We had previously obtained Judgment against a debtor for a client in the sum of £5,000. However, at the time the debtor had insufficient assets in which to settle the debt. Nine months later the debtor's circumstances changed, when they purchased a property. We commenced enforcement action on behalf of the client and obtained a Charging Order against the Property. This provided long term security for the debt.
