SALE AND PURCHASE OF VACANT PROPERTY
Two years ago tbi were introduced to a new client who had an opportunity to buy a vacant industrial estate, if we moved quickly. tbi travelled to London with the client the following day and exchanged contracts – since then the estate has been fully let and a strip of vacant land along the boundary has been sold for a price exceeding the original purchase price.

SALE AND PURCHASE OF INVESTMENT PROPERTY
tbi has recently acted for a client in the purchase of a shopping centre subject to occupational leases. This involved providing a full report on the terms of the existing leases and we continue to be involved in dealing with requests from the tenants for various consents and the grant of new leases when tenants vacate.

tbi acted for one client in the sale of part of its property portfolio of industrial premises for a price of GBP4.5 million.

OPTIONS OF LAND
tbi act for a large building company who acquire sites for residential development. tbi regularly procure the grant of option agreements to enable soil samples to be tested for potential contamination and planning permission obtained for the proposed development prior to our client being legally committed to the purchase.

MORTGAGES ACTING FOR BORROWER
tbi acts for a developer who buys sites for development and then arranges finance from a lending institution in order to finance the development. tbi advises on the security requested by the lender from the terms of the legal charge to any personal guarantees or debentures which are required.

MORTGAGES ACTING FOR LENDER
tbi acts for one of the main Banks in ensuring that they have effective security whether it is by a charge over property, a debenture or a personal guarantee or by a charge over building documentation. tbi has recently drafted a complex deed of priority to govern the priority of the securities held by two lenders.

SALE OF DEVELOPMENT PROPERTY
tbi has recently acted in the sale of a large area of agricultural land which was subject to a complex overage agreement to ensure that seller received a share in any subsequent increase in value of the land as a result of planning permission being granted for development.

PURCHASE OF DEVELOPMENT PROPERTY
tbi was involved recently in the acquisition of a development site from the local authority for development as a business park. The purchase agreement contained provisions regulating the development and was also subject to a back to back agreement in relation to part of the site.

LANDLORD AND TENANT
tbi acted in the acquisition of development land and the granting of security over the property to finance the development of an extensive business park and is now acting in the preparation and grant of the leases of the offices at the business park.

tbi acts for the owner of a larger office block which is subject to short term lettings in relation to the preparation of the leases and excluding the leases from the security of tenure provisions of the Landlord and Tenant Act 1954.

SALES AND PURCHASES OF PROPERTY BY PENSION FUNDS
tbi has considerable experience in dealing with the acquisition and sale of investment property through Self Invested Personal Pensions schemes (SIPPs) and Small Self Administered Schemes (SSASs). tbi works very closely with one SIPP provider and are one of two firms of solicitors on their panel to act on their behalf in purchases of investment property. tbi is able to work quickly, without cutting corners, when the situation requires and have recently acted in the acquisition of a GBP2,250,000 building by a SIPP, subject to an occupational lease, which was completed within 3 weeks of receiving initial instructions.

BUYING AND SELLING PROPERTY AT AUCTION
tbi acted in the sale of an investment property which was subject to occupational leases at auction. tbi prepared a comprehensive legal package and liaised with potential bidders and the auctioneers and the property was eventually sold for considerably more than its reserve price.

tbi acted recently for a client who was interested in purchasing a property at auction. tbi attended the auction with the client and advised him on the legal issues affecting the properties he was interested in bidding for.
