Disputes

Hello, I'm Alison Leith and I'm the partner who runs the Commercial Disputes Department. Over the years we've built one of the region’s strongest teams of commercial litigators who have a wide range of experience in all areas of business and property disputes. We have won many court cases and achieved successful outcomes through mediation and other alternative dispute resolution procedures for our clients. We understand that disputes with another company or an individual can be distracting and often have a negative impact on your business. We will support you from the first indication of any issue through to conclusion, working with you in order to resolve the matter and minimise the disruption and cost to you and your business.

Ask Alison Leith

Running a business can be difficult at the best of times.  If a dispute arises, managing that issue can become stressful and distract you from the day to day management of your business.  Litigation is not always the most appropriate way of dealing with disputes and they can often become blown out of proportion very quickly.

Whether you are in dispute with suppliers, customers, contractors, investors, business partners or others, we are sure that you would prefer to have that dispute resolved quickly and with minimum disruption and cost to you and your business.  At Tilly Bailey & Irvine we have a team of commercial lawyers who are highly experienced and knowledgeable in all areas of litigation.  We advise on the legal position and enter into litigation when necessary but also focus on your priorities so that the most effective strategy can be adopted from the outset to achieve your preferred outcome.

If you find yourself in a conflict situation we would suggest you contact Alison Leith, Head of the Commercial Disputes Team.  She and her team will assess your position and discuss with you the most appropriate course of action.

The Legal 500 comments: “Partner Alison Tate heads an expanded team at tbi which has acted on a variety of disputes, including the defence of a £1m claim for wrongful termination and breach of contract and the defence of a multi-million pound minority shareholder claim. The firm has also handled a number of high-value breach of warranty claims.”

Recent client stories

Success for 77 homeowners

Alison Leith and Debra Burton acted on behalf of 77 homeowners who purchased houses which had been built by Shepherd Homes Limited with defectively designed foundations (Harrison & Others v Shepherd Homes Limited & Others 2010 [EWHC] 1398 (TCC); [2011] EWHC 1811 (TCC); [2012] EWHC Civ 904 (Court of Appeal).  Following a 5 week trial of ten lead cases in the Technology and Construction Court, Mr Justice Ramsey gave Judgment in favour of our clients, awarding 6 figure sums in damages to each of them.  The Defendant appealed to the Court of Appeal and Judgment was given in favour of the Claimants in July this year dismissing every ground of appeal.  Alison and Debra achieved settlements for the 67 non lead claimants following individual mediations.  The case involved complex legal argument together with detailed engineering and valuation evidence.  Alison and the team were delighted to have achieved a successful outcome for all claimants after a hard fought, lengthy battle.
