				<content:encoded><![CDATA[<p>Tilly Bailey &amp; Irvine Solicitors has enabled a local business to find and purchase the ideal property in which to continue its impressive growth.</p>
<p>Hospitality Guaranteed Ltd has recently completed relocation to its new offices at Wynyard Park.  The company had outgrown its offices in Castle Eden.  Victoria Brunton, of Hospitality Guaranteed, said: “With 11 people in the company now, and plans to add up to 10 more, we needed lots more space, and Tilly Bailey &amp; Irvine Solicitors has helped us find the ideal office building.”</p>
<p>Hospitality Guaranteed purchased its new offices, rather than leasing them.  Andrew Beattie, commercial property specialist with Tilly Bailey &amp; Irvine Solicitors, recommended the property and negotiated the purchase.</p>
<p>Amanda Jackson, of Hospitality Guaranteed, added: “Our new location is not only centrally located for our team, but also has easy links to both the A19 and A1.  Add to that the range of facilities on the Wynyard site, and this is ideal for our growing company.</p>
<p>“Finding a property in the right location has taken some time and Andrew has helped us through the complications to the exciting point where we moved in.  It is incredible that in seven years we have grown from a front room to these impressive and professional offices.  We aim to continue growing and will happily work with Andrew again when we outgrow these premises.”</p>

				<content:encoded><![CDATA[<p>The son of a prolific local fundraiser is participating in one of the UK’s most challenging endurance events to raise funds for one of his late mother’s favourite charities.</p>
<p>John Bell is currently training for the Forces March, an event in which walkers, runner and hand-cyclists complete the equivalent of five marathons in five days.  The Forces March takes place in Devon from Wednesday 22<sup>nd</sup> to Sunday 26<sup>th</sup> May, 2013, raising funds for The Veterans Charity.</p>
<p>John Bell, 34 from Greatham in Hartlepool, works for Ron Perry Breakdown and Recovery Ltd.  He is competing in memory of his late mother, Beverley Bell, who battled breast cancer for many years.  Beverley sadly died in December 2012.  She was well known for her fundraising for Hartlepool Hospital’s Cancer Unit.  John’s brother has completed the Forces March for the last two years, with John acting as support driver.  This year, his brother and father are acting as his support team.</p>
<p>John commented: “Mum began supporting the charity when my brother took part in the Forces March.  When I told her of my plan to participate, it put such a smile on her face.</p>
<p>“At this stage, I’m both excited and daunted.  I want to get to Devon and get ready to go.  However, I’ve never put my body through anything like this, and I’m not sure what I’ll be like afterwards.”</p>
<p>Beverley Bell worked for Tilly Bailey &amp; Irvine Solicitors in the firm’s Hartlepool-based Investment Department.  The local legal firm is donating £1 for every mile of the endurance race, in Beverley’s memory.  Mark Ellis, partner with Tilly Bailey &amp; Irvine Solicitors, commented: “Beverley was an inspiration to all of us at Tilly Bailey &amp; Irvine Solicitors with her regular fundraising events.  It comes as no surprise that her son is following in her footsteps, taking on an incredible challenge in his mother’s memory.  We’re glad to be able to support him and wish him every success.”</p>

				<content:encoded><![CDATA[<p>A regional law firm has called on employers to ‘think twice’ before purchasing an ‘Employment Law Consultancy’ package.</p>
<p>Theresa Carling, Employment Solicitor with Tilly Bailey &amp; Irvine Solicitors, says the firm is taking over an increasing number of cases where the employer’s insurance package has not covered the company’s legal needs, or a poor level of service has compelled them to seek guidance elsewhere.</p>
<p>She commented: “A retained package of employment law support may sound ideal for your company, but we are witnessing many instances where it has proved to be a false economy.”</p>
<p>The problems faced by clients, which have prompted them to seek local legal guidance instead, have included finding that cases are not covered under the terms of the insurance, dealing with different contacts so no one person knows the case well enough, inexperienced advisors, and advisors with such large caseloads they do not have time to respond, keep the client updated or see if there is scope for early settlement to save management time.</p>
<p>Sara Mctrusty, HR Manager for MJF Cleaning Services in Darlington turned to Tilly Bailey &amp; Irvine Solicitors in similar circumstances.  Sara said: “From the minute I changed to Tilly Bailey &amp; Irvine Solicitors I felt reassured and confident that the matter would be dealt with promptly and professionally, and that is exactly what happened.  The communication, advice and support given instantly highlighted a massive gap, far greater than I would have imagined, when compared with the original consultancy’s advice and level of communication.  With the consultancy, it felt like they were biased to the claimant rather than our company as their own client, and certainly were not viewing things from the client’s point of view or taking any great steps in assisting us to make sound business-based decisions.”</p>
<p>Glen Cowan, HR Co-ordinator with CBL Cable Limited in Hartlepool, also sought legal advice from Tilly Bailey &amp; Irvine Solicitors when their retained employment consultants appeared to be steering their claim towards a very expensive tribunal award, without providing the support and advice they needed.</p>

<p>There is a huge amount of help and advice available to people to guide them through all the areas of choice they have. Choice about planning their finances, choice about how and where they are cared for if they become seriously ill or are no longer able to make their own decisions.</p>

<p>There are a huge range of choices today regarding planning everything from what happens to your loved ones and your possessions when you die, to what kind of funeral you could have.</p>
<p>Coping with the stress caused by a life limiting illness or loss of control over your life or a loss of ability is very challenging, however, there are many interesting ways to combat stress now and improve the quality of your life.</p>
<p>The end of our lives matters to us all. It&#8217;s the most permanent thing that happens to any of us. Is that the problem? Why do we shy away from talking about arguably the most important thing that will ever happen in our lives?</p>
<p><b>Here are a few facts to consider:</b></p>

<li>81% of people have not written down any preferences around their own death</li>
<li>25% of men across England haven&#8217;t told anyone about the funeral arrangements they would like to have</li>
<li>35% of women across England have not discussed their funeral either</li>
<li>63% of us would prefer to die at home, yet of the half a million of us who do die each year</li>
<li>53% of us die in hospital</li>
<li>60% of us have not made a will,</li>
<li>25% of that number are over 65.</li>
</ul>
<p>It is believed one of the things we fear most about dying is the loss of control but by discussing your wishes, making them clear and getting ready in good time you will be in control of a great deal more of your life, your care and what happens to you, your loved ones and your possessions than if you didn&#8217;t discuss your wishes.</p>
<p><b>There&#8217;s no time like the present</b></p>
<p>No-one wants to think about getting ill; having a stroke for instance or developing Alzheimer&#8217;s disease or having a serious accident that leaves us unable to conduct our affairs but these things do happen to many people every day.</p>

				<content:encoded><![CDATA[<p>Tilly Bailey &amp; Irvine Solicitors is asking people to make their will and help a vital local hospice at the same time.</p>
<p>Hartlepool Hospice’s annual ‘Make a Will Month’ will take place in May 2013, when Tilly Bailey &amp; Irvine Solicitors will invite anyone making or updating a will to make a donation to the charity instead of a paying the solicitor’s fee.  Last year, Tilly Bailey &amp; Irvine Solicitors’ clients raised approximately 45% of the total sum, and Carolyn Tilly hopes the firm will be able to support the hospice similarly in 2013.</p>

<p>WynyardPark is launching its Enterprise Initiative as part of its on-going efforts to boost the local economy.</p>
<p>Working in partnership with four of its tenant companies, the 700-acre business park is targeting relatively new start-up companies and entrepreneurs with great ideas in a bid to help create a successful and sustainable business.</p>
<p>The winner of the 12-month support package will receive a fully-serviced office from WynyardPark and IT/telecommunications, accountancy, marketing/public relations and legal support from Communicate plc, Evolution LLP, Velvet Communications and Tilly Bailey and Irvine Solicitors respectively.</p>
<p>In addition, the winning business will get the chance to work with a team of high-profile mentors, including Chris Musgrave, Chief Executive of Wynyard Park, and Trevor Cartner, Chairman of Helios Properties and WynyardPark.</p>
<p>Matt Johnson, WynyardPark’s Development Manager, said: “We already have a proven track record of supporting the creation of small businesses at WynyardPark through our hugely successful Serviced Office Scheme which enables new companies to establish themselves and grow through flexible packages tailored to suit their needs.</p>
<p>“The Enterprise Initiative aims to build on this by creating a platform to support new and emerging businesses across the TeesValley.</p>
<p>“We believe we have developed an offer which any new company would significantly benefit from and we would encourage relatively new start-up companies and people thinking of starting a business from across the TeesValley to enter. There’s nothing to lose but an awful lot to gain.</p>

One business will then be chosen to win the overall package and two runners-up will receive a support prize worth £500.</p>

				<content:encoded><![CDATA[<p>One of Tilly Bailey &amp; Irvine’s clients, Datum360, supplier of software solutions &amp; services to help Oil &amp; Gas companies specify, capture and manage engineering information for capital intensive projects, has announced that it is accelerating its growth plans, with the injection of an additional £450k of funding from the Finance for Business North East Technology Fund (NETF) managed by IP Group plc.  This will enable the company to capitalise on the opportunities provided by its recent Information Management software releases.</p>
<p>£50k has also been invested from the Northern IT Research Fund (NIRF) managed by IP Group plc, pushing the investment total up to £1m when taking into account the £500k provided from the NETF in 2012.</p>
<p>Datum360 had a successful 2012, with substantial growth in clients, new projects and the team, all of which have prompted the business to move towards a software-led strategy.</p>
<p>During the last 12 months, Datum360 gained new clients such as Total E&amp;P Norge, Tullow Oil and JX Nippon and won notable additional projects from BP, Maersk, ConocoPhillips, Woodside and GDF Suez.</p>
<p>In 2012, Datum360 announced highly innovative software solutions, PIM360 and CLS360, that provide information management capabilities that were previously not available from any supplier. They help to automate and improve Information Management processes that acquire, manipulate and condition engineering data.</p>
<p>As a result of this growth, and the strength of the new software solutions, IP Group has increased the funding provided to Datum360 through the NETF and added further investment through the NIRF, which will be used to accelerate the introduction of PIM360 and CLS360 into new clients and new markets worldwide.</p>
<p>Steve Wilson, Chief Executive of Datum360 said, “This new funding will allow us to bring forward our expansion into North America and South East Asia, while continuing to enhance and extend the capabilities of PIM360 and CLS360, our Software as a Service offerings”</p>
<p>Nick Edgar, investment manager at IP Group, said: “The last twelve months were extremely strong for Datum360, giving them an excellent platform for further growth in 2013.</p>

				<content:encoded><![CDATA[<p>Tilly Bailey &amp; Irvine&#8217;s clients have once again made it one of the most successful firms in the North East in raising money for the charity, Will Aid, despite the current economic crisis leading many to ‘tighten their belts’.</p>
<p>Tilly Bailey &amp; Irvine Solicitors participated in Will Aid month by replacing their normal fee with a donation to the charity for all normal wills drawn up during November 2012.  During the month, Tilly Bailey &amp; Irvine Solicitors’ clients donated £6,500, one of the highest amounts raised by a North East firm, and the 26<sup>th</sup> most successful firm in the UK.</p>
<p>Carolyn Tilly, partner with Tilly Bailey &amp; Irvine Solicitors, said: “We’re very proud of the generosity of our clients in once again raising so much for Will Aid.  It is obvious that our clients see this as a great way to support the work of these vital charities, and to ensure the futures of their loved ones through making or updating their will.  Will Aid is often the catalyst that brings people in to make their will, a task that is so often left on a person’s ‘to do’ list.  We plan to continue supporting Will Aid in the future, with the help of our clients, of course.”</p>
<p>Val Barron from Christian Aid received the donation on behalf of Will Aid.  She added: “Tilly Bailey &amp; Irvine Solicitors has supported Will Aid for many years, and all the charities are grateful not only for the fundraising, but also for the awareness they spread about the work the charities carry out both in the UK and overseas.  In total, Will Aid 2012 raised over £1.8 million pounds across the UK, which is especially generous when times are increasingly tough for many.”</p>
<p>Since it began supporting Will Aid, Tilly Bailey &amp; Irvine Solicitors has raised over £27,000 for the charity which uses the funds to help vulnerable children, families and older people through the nine chosen charities; ActionAid, Age UK, British Red Cross, Christian Aid, NSPCC, Save the Children, Sightsavers, SCIAF and Trocaire.  Tilly Bailey &amp; Irvine Solicitor’s offices in Hartlepool, Stockton on Tees and Barnard Castle participated in the scheme.</p>

				<content:encoded><![CDATA[<p>A regional lawyer is reminding families they have may have a right to claim care homes fees paid – but that any claim must be made before the Government’s deadline.</p>
<p>Nicola Dalzell of Tilly Bailey &amp; Irvine Solicitors says there was plenty of publicity in Autumn last year around the deadline for claims dating back to 2004.  However many people may not be aware that there is now an annual deadline set.  This means that claims for care fees between 1 April 2011 to 31 March 2012 must be submitted before the end of March, 2013.</p>
<p>People who paid for care home fees during that time may be entitled to reclaim those fees from the NHS if the primary reason for care was physical or mental health needs.</p>
<p>Nicola commented: “In many cases, people do not know that there is an opportunity to claim now for care dating back to April 2011.  Even if the person the claim relates to is no longer alive, the family could be entitled to reclaim the money spent on the care home fees.  The important thing is to submit any claim before the end of March.”</p>
<p>Nicola believes many people are funding their own care when they might be eligible for NHS Continuing Healthcare.  She says: “If a person’s primary need for care is because of nursing or health care needs, then they should be assessed to find out if they are eligible for NHS Continuing Healthcare.  Also, if someone has been assessed and refused, they have the right to appeal and they or their family should seek expert help.”</p>

<p>Carolyn Tilly, Partner at Tilly Bailey &amp; Irvine Solicitors, explains:  “It is sometimes necessary to take over the affairs of a loved one.  For example, those suffering from dementia or strokes may struggle to communicate their wishes, or people with long-term illnesses can find themselves housebound or in hospital for long periods of time and have to depend more and more on family and friends.  It is important to grant someone you trust the power to act on your behalf and in accordance with your wishes.</p>
<p>If there is no Lasting Power of Attorney in place and someone loses capacity to manage their own affairs, then the family will usually have to go through the Court of Protection which is a more lengthy, costly and bureaucratic process.  It can take 6-7 months to obtain an Order of the Court of Protection to look after someone’s financial affairs and also there is an onerous requirement to file yearly accounts and take out insurance which is not necessary where a Lasting Power of Attorney is in place.</p>

				<content:encoded><![CDATA[<p>A regional specialist in family law has called for farmers to ensure their plans regarding the ownership of their land and properties are legally documented to protect their family business in the event of divorce.</p>
<p>Victoria Moreton, a partner with Tilly Bailey &amp; Irvine Solicitors, says that farmers must ensure ownership and succession planning for their properties and land is legally documented.  Also should they marry or cohabit, formal plans should be put in place as to the future of these assets should the relationship end.</p>
<p>A number of factors have caused farmers to be faced with increased payouts in the divorce courts.  Courts will take into consideration the fact that the farmhouse, whilst considered a family heirloom, is also often the matrimonial home.  Additionally, a dramatic rise in the value of agricultural land in recent years has also been reflected in divorce settlements.  With land often valued over £7,000 per acre, and farm houses considered desirable properties, the assets of even a relatively modest-sized farm can easily be valued at several million pounds.</p>
<p>Ms Moreton said: “For many years, farm assets have been handed down through the family, with these arrangements based on trust.  To document such agreements requires a change in mentality, but it is now important to ensure the desired future.  We’re now seeing family assets being subject to litigation, potentially putting the business at risk, or resulting in a very high cash payout to the former spouse.</p>
<p>“It is vital that farmers ensure there is legal documentation which clearly states whether the property is a benefit for the person’s lifetime or an outright gift.  It is also essential when marrying or co-habiting that consideration is given to what should happen should the couple split.”</p>

				<content:encoded><![CDATA[<p>Forthcoming changes to employment legislation have been welcomed by one of the region’s employment lawyers, as she believes it will lead to lower costs for employers facing unfair dismissal cases.</p>
<p>Theresa Carling, Employment Law Solicitor with Tilly Bailey &amp; Irvine Solicitors, has welcomed part of the new legislation which is due to come into force in the Summer of 2013.  The new legislation will cap the amount of unfair dismissal compensation due to successful claimants to a maximum of one year’s salary.  She said: “This change will give employers some certainty.  Currently, compensation in these cases can be incredibly difficult to assess.  The limit of 12 months’ salary gives a clear starting point for negotiations.  It will be much easier to assess the likely award and will enable the parties involved to enter into sensible negotiations away from tribunal.  The result will be more cases settled between the parties which is great news for our regions’ businesses.”</p>
<p>The new legislation will limit compensation for unfair dismissal to 12 months’ salary for successful unfair dismissal cases in the UK, subject to the current cap of £72,300*.</p>
<p>Theresa added: “To date, when heading to a tribunal for unfair dismissal, it has been very difficult to estimate what the compensation award in unfair dismissal cases might be.  The claimant is expected to mitigate his or her loss of earnings by seeking alternative work, and, where this has been done, there can still be a future loss of earnings awarded.  The difficulty for the former employer is that they only have a sketchy idea of what the employment judge might order in respect of this.  This can hinder cases where claimants have inflated expectations about the likely levels of compensation which could be awarded.  The new legislation gives a clear picture of what the highest possible award will be, allowing a business to complete an accurate cost/ benefit analysis and assess which course of action would be the most appropriate, defending employment tribunal proceedings or negotiating a settlement.”</p>

<p>Kirby Owens has joined Tilly Bailey &amp; Irvine Solicitors’ Personal Injury team, working in the firm’s Stockton office.  Kirby graduated in 2010, having completed the four year LLB (Hons) Law Exempting degree at Northumbria University.  She has since gained more than two years’ legal experience, the majority of it in personal injury work.</p>
<p>Kirby commented: “Joining Tilly Bailey &amp; Irvine Solicitors is ideal.  The firm’s personal injury department is well-respected in the region, but the team remains small enough for me to be able to make a difference through my work.  I’m already working closely with clients and able to provide them with any guidance needed.  Clients seeking Personal Injury advice are often going through testing and stressful times, and it’s important to me that I can be available when they need reassurance.”</p>

				<content:encoded><![CDATA[<p>Once again, during November, Tilly Bailey &amp; Irvine Solicitors is taking part in <a href="http://www.willaid.org.uk/">Will Aid</a>, the national campaign to raise money for charity whilst also encouraging people to ensure they have a will which is fit for purpose.</p>
<p>Throughout the month, anyone can come to Tilly Bailey &amp; Irvine Solicitors to draw up a basic will without paying us a fee.  In return for this service, we ask that clients make a donation to Will Aid.  The guide donation is £90 for a single will, £135 for a pair of ‘matching’ wills and just £40 for a codicil or alteration to an existing will.  Will Aid clients will also be able to register their wills free with <a href="http://www.certainty.co.uk/">Certainty</a>, the National Will Register. This means that a will can be quickly and easily located when it is needed.</p>
<p>Will Aid is the UK’s top charity will-writing scheme, encouraging everyone to update their will with a fully-qualified solicitor in return for a donation to the charity.  The money raised this month will be shared between nine well known charities; ActionAid, Age UK, British Red Cross, Christian Aid, NSPCC, Save the Children, Sightsavers, SCIAF (Scotland) and Trocaire (Northern Ireland).</p>
<p>Writing a will is one thing often ‘put on a back burner’.  Understandably, many people believe there will always be plenty of time to prepare their will.  We hope this opportunity to support nine fantastic charities will encourage people to make time to prepare their will now.  The result will not only be to ensure loved ones are provided for in line with their wishes, but also the satisfaction of helping people in need in the UK and beyond.</p>
<p>Last year, our clients raised more than £7,000 for Will Aid, an especially impressive total considering the economic crisis.  We’d like to thank everyone who took the opportunity to make their will last year.  Hopefully, Will Aid will prove a catalyst again this year, encouraging many more to make their will and support these charities.</p>

				<content:encoded><![CDATA[<p>It is entirely possible to apply for probate and deal with an estate, without seeing a lawyer, but it’s not without risks warns legal group, Solicitors for the Elderly (SFE).</p>
<p>Many professionally drafted Wills contain trusts to save tax, to avoid those who inherit paying care fees and to reduce the likelihood of potential disputes.  SFE members have noticed an increase in ‘DIYers’ returning to them to seek advice when they have made a mistake or find the paperwork too tricky.  Mrs A’s Will had included a tax saving trust, but when her husband administered the estate, he paid the whole estate to himself.  The solicitor was thankfully able to sort out the matter and avoid future complications occurring when Mr A eventually dies.  In Mr G’s case, he sold some shares that had made a gain during the administration of his late sister’s estate and had to pay tax.  If he had transferred the shares to himself first, before selling them, he could have avoided the tax.</p>
<p>Local SFE member and solicitor at Tilly Bailey &amp; Irvine, Annaliese Barber said “People aren’t always aware of the complexities and assume probate work is straightforward.  It is true that it can be, but it is just as true that sometimes it isn’t.  In all but the most straightforward cases, it is important to seek timely specialist legal advice that can actually save you money and worry.”</p>
<p>Many SFE members’ practices such as Tilly Bailey &amp; Irvine will offer to work in partnership with the deceased’s family to help and support them with the legal and technical work.  As elderly law specialists, members can even add value to their work, for example by identifying cases where money is owed to the estate for care funding, which should have been met by the NHS and assist in making a claim.</p>

<p>Victoria Cornfield has joined Tilly Bailey &amp; Irvine Solicitors as the firm’s new Marketing Executive.  Tilly Bailey &amp; Irvine Solicitors is one of the Tees Valley’s longest established law firms, dating back to 1841.</p>

<p>Helen Elstob, of Tilly Bailey &amp; Irvine Solicitors, says she is already representing a number of clients who have suffered varying symptoms which were eventually attributed to the hip replacement implant.  She said: “Some have suffered symptoms which do not appear to be associated to the hip, whilst others have initially had only minimal discomfort in the hip, which gradually worsened.  However, investigations have shown that the implants can cause the release of metal debris into the joints, muscles and blood stream.”</p>
<p>Some metal on metal hip implants were withdrawn in 2007.  The implants were made by DePuy, an American division of Johnson and Johnson, and were used in hip resurfacing and total hip replacements between 2003 and 2010.  They were withdrawn on 7<sup>th</sup> September, 2010 because of the high number of patients requiring revision surgery.  Anyone with these implants should have received notification from the hospital.  However, it is not known if these letters have been received by all relevant patients.</p>
<p>These implants have been shown to cause tiny metal fragments to be released into the joint.  The result has been symptoms including pain in the hip, groin or knees, clicking in the hip joint, a general unwell feeling, or headaches and dizziness.  This condition is known as ALVAL (aseptic lymphocytic vasculitis- associated lesions).</p>
<p>Ms Elstob recommends that anyone who underwent a hip replacement between 2003 and 2010 should initially contact their doctor for a blood test.  Following that, they could be required to undergo ultrasound, aspiration of fluid from the hip and ultimately revision surgery.  She commented: “Patients are suffering discomfort, pain and uncertainty because of this.  They could be entitled to compensation and should consider consulting both a doctor and a specialist lawyer.”</p>
<p>Furthermore, a recently published study by Bristol University into the failure rates of metal on metal hip resurfacing has found the procedure to have much higher failure rates than full hip replacements.  Whilst hip replacements have a two per cent failure rate in five years, hip resurfacing was found to have a five per cent failure rate.  However, in women the failure rate was reported to be up to five times greater prompting researchers to recommend that this procedure is never used in women.  Helen added: “Thousands of people have had this type of surgery in recent years.  If anyone is having any symptoms which they believe could possibly be attributed to the implant, now is the time to speak to a doctor so they can have the relevant tests.  We have experience in guiding patients through the process, and are happy to speak with anyone who is considering a claim.&#8221;</p>

				<content:encoded><![CDATA[<p>An ambitious law graduate has joined Tilly Bailey &amp; Irvine Solicitors’ commercial law team as a paralegal, hoping the position will put him on the right track for his dream career.</p>
<p>Jonathan Wall, from Spennymoor, has joined Tilly Bailey &amp; Irvine Solicitors’ commercial department as a paralegal, working initially within its commercial property team.  He graduated from his Legal Practice Course at Liverpool John Moores University in 2011, and has since been working for ESH Group, the Bowburn-based construction firm.</p>
<p>He said: “Tilly Bailey &amp; Irvine’s commercial team are not only impressively knowledgeable and experienced, but also extremely friendly and welcoming, and I am delighted to join the team.</p>
<p>“As there are fewer solicitors’ training posts available in the current economic climate, my aim is to progress from paralegal to a training role and from there to fully qualified commercial solicitor.  Joining Tilly Bailey &amp; Irvine Solicitors is the first step towards my planned career.”</p>

				<content:encoded><![CDATA[<p>A specialist in employment law has called on private sector employers to carry out an equal pay audit on their business – before they have to justify pay levels in the courts.</p>
<p>Theresa Carling, employment law specialist with Tilly Bailey &amp; Irvine Solicitors, said: “The public sector has faced numerous equal pay claims, and paid out millions in compensation and legal fees.  It is only a matter of time before private sector employers face scrutiny too.</p>
<p>“The current economic crisis could be the catalyst.  With the increased cost of living and a freeze on salaries, staff may begin to compare salary levels.  The employer must be able to justify any differentials between people who do the same work.”</p>
<p>Ms Carling recommended that employers conduct an equal pay audit to establish that all people doing the same job receive the same pay.  Any differences in pay need to be justifiable.  She warned that successful claimants can claim for up to six years back pay, including additional interest.</p>
<p>She added: “The Equal Pay act was introduced in 1970.  In the subsequent years, the gender gap has narrowed but there is still plenty of evidence to show that men are generally paid higher wages than women, results fuelled to a large extent by the private sector.</p>
<p>“The North East is renowned as a hotbed for equal pay claims.  Regional firms have targeted public sector employees to bring equal pay claims.  As those cases and their appeals are settled and awards are paid out, the same firms are likely to turn their attention to the private sector and encourage employees to actively look for discrepancies in pay levels.”</p>
<p>Theresa’s comments come in the wake of a Channel 4 programme, Show Me Your Money, where the staff of a London plumbing firm were challenged to tell each other how much they earn.  The programme unearthed issues of unjustifiable inequality in pay, which needed to be, and was, addressed.</p>
<p>Theresa concluded: “The private sector does not operate with established pay bands.  Instead there has always been a veil of secrecy around wages.  Private sector employers should act now and demonstrate that they are aware of the law and that they are confident that their pay structure is absolutely fair.”</p>

<p>As a campaign supporter of Remember a Charity, the firm who have specialists in Wills and Trusts have been handing out tea bags on behalf of the charity to visitors to their offices in Hartlepool and Stockton, as part of an initiative for people to consider leaving a gift to charity in a Will, whilst looking after family and friends over a cup of tea. </p>
<p>Thankfully 74% of the UK population support charities and when asked 35% of people say they would be happy to leave a gift in their Will once family and friends are provided for.  The problem is only 7% actually do. Leaving money to a charity makes a huge difference; if this figure was raised by just 4% it would generate an extra £1 billion for UK charities every year.</p>
<p>Carolyn Tilly, Partner at Tilly Bailey &amp; Irvine who runs the Probate, Wills &amp; Trusts department adds, “The facts are clear, only a small proportion of the population set their affairs in order with a properly arranged Will.  This advice and the Will don’t have to cost the earth and it gives you the peace of mind that your loved ones will be provided for.  It also gives you the opportunity to leave a lasting legacy.  Legacies from supporters are the foundation of many good causes in the UK, you don&#8217;t need to leave a lot to charity to make a difference.”</p>

<div>Angie Goodall, Debt Advisor with Tilly Bailey &amp; Irvine Solicitors, says: “People can become incredibly burdened by debt.  However, most people do not know about Debt Relief Orders.  These are ideal for smaller debts, leaving the person debt free in a year, without having to pay back what they owe.  It is the ideal way to get back on track and out of debt.”</div>

<div>Tilly Bailey &amp; Irvine Solicitors has been appointed by the Legal Services Commission to act as the Hartlepool advisor on social welfare under the legal aid scheme.  Through this scheme, it can obtain Debt Relief Orders for clients who meet the criteria.  This option is open to anyone owing no more than £15,000, with assets no greater than £300, and with less than £50 disposable income each month.</div>
<div></div>
<div>The debts are listed against the order, and, providing the person’s circumstances do not improve within 12 months, the debt is written off and they are then free of debt.  The only requirement is that the person pays a £90 fee to the insolvency service to process the application.</div>
<div></div>
<div>Angela added: “For many it’s a challenge to pay the £90 fee, but they find a way knowing that they will no longer have to deal with creditors and will ultimately be debt free.  You can sense the relief once the order is in place.</div>
<div></div>
<div>“Often people have suffered because of a change in circumstances leaves them unable to meet their outgoings.  However, we also see young people who have accepted credit despite being unable to meet the repayments.  What’s most important is that people know they have options and come and speak to us rather than to let debt get out of hand.”</div>
<div></div>
<div>The Debt Relief Order process is normally completed within six to eight weeks.  Angie Goodall and her colleague Mick Gordon are authorised intermediaries and members of the Institute of Money Advisors (IMA) and are able to process the applications.  As well as Debt Relief Orders, they can offer other solutions including bankruptcy orders, administration orders, or negotiation of reduced payments.</div>

<p>Tilly Bailey &amp; Irvine Solicitors has brought together a team of specialists in housing, debt and social welfare issues to offer a one-stop shop to advise and help, open from Monday to Friday in the centre of Hartlepool.  The firm has been appointed by the Legal Services Commission to provide these services under the Legal Aid Scheme, thereby ensuring those eligible will have their fees covered.</p>
<p>Claire Harrington, Welfare Benefit Advisor with Tilly Bailey &amp; Irvine Solicitors, commented: “Many people who feel their personal situation is deteriorating are only aware of the services that are disappearing.  It is vitally important that people know where they can come for help.  Whilst traditionally solicitors might not have been your starting point, we want people to know that there is a team here who are helping people daily, and making a real difference for people here in Hartlepool.”</p>

				<content:encoded><![CDATA[<p>Three Teesside professional services firms have joined forces to enable Cordell Group Limited to complete the purchase of a Middlesbrough marine engineering business and its riverfront site.</p>
<p>The purchase will allow relocation of one of Cordell’s divisions to a prime site on the River Tees. This will lead to growth on the site and the creation of new jobs in Teesside.</p>
<p>Evolution Business Advisors, Tilly Bailey &amp; Irvine Solicitors and Close Thornton Solicitors assisted Cordell Group in the purchase of Aveco (Teesside) Limited, a family firm based in Normanby Wharf, Middlesbrough. Aveco, a privately owned marine engineering firm, was founded in 1977 by Dennis Aveling. It has a distinguished history of marine craft building in Teesside.</p>
<p>The new Middlesbrough site will be used by Cordell Group for fabrication, machining and pipework, with its frontage onto the River Tees allowing easier access and berthing thereon.</p>
<p>David Rush, managing director of Cordell Group, said: “Over more than 30 years, Aveco has built an excellent name in its industry sector and helped Teesside maintain its worldwide reputation for marine engineering. Cordell Group is looking to expand and this ideal riverfront site will play an integral part in our company’s growth and the future of marine engineering on the Tees.</p>
<p>“It is testament to the expertise of Evolution, Tilly Bailey &amp; Irvine and Close Thornton that this deal has been completed on schedule.”</p>
<p>Evolution Business and Tax Advisors counselled Cordell Group management throughout the negotiations. Andrew Fotheringham of Evolution LLP commented: “Cordell Group brought the three teams together to ensure smooth progress of an intricate deal. We have worked together effectively and in harmony, ensuring any issues are responded to promptly.”</p>
<p>David Hogg, partner with Close Thornton Solicitors, represented Cordell in its purchase of Aveco (Teesside) Limited. He said: “The process has seen us not only completing the purchase of Aveco’s marine engineering business, but also putting in place a new financing structure to facilitate Cordell Group’s growth plans. Inevitably, such a deal has required a substantial effort from all parties involved.”</p>
<p>Martin Levinson, partner and commercial property specialist with Tilly Bailey &amp; Irvine Solicitors, acted in the purchase of the land. He added: “In such a deal, it is inevitable that a number of professional services companies are required to work closely together. Everyone has cooperated fully to complete an intricate transaction and it was a pleasure to be part of a first class professional Team. We are delighted that the acquisition has been successfully completed.”</p>

<p>A local solicitor has developed her career to become a specialist in abuse claims, one of very few in the North East of England.</p>
<p>Helen Elstob, a solicitor with Tilly Bailey &amp; Irvine Solicitors, deals with abuse, neglect and injury claims in children and adults and is currently managing a number of claims.  A claim for financial compensation for abuse, neglect and injury can be made against an individual and/or organisation with a duty of care, including local authorities, schools, protection agencies, care homes and hospitals.</p>
<p>John Hall, managing partner with Tilly Bailey &amp; Irvine Solicitors, commented: “Any claimant in this situation will not automatically know where to turn.  Helen is one of very few solicitors in the North East with this niche experience.  She has developed her expertise, investing time and effort into ensuring she is up to date on case law, and also building excellent relationships with the barristers working in this specialist field.”</p>
<p>In recent years, the media has reported rising numbers of abuse and neglect cases.  However, those working to secure compensation for the victims believe that only a small percentage of victims come forward.  Helen commented: “Colleagues in this field across the country are concerned that the majority of victims do not speak up and do not come forward to seek compensation.  Claims can be pursued against schools, local authorities, churches and other organisations that failed in their duty of care.  Many victims are simply not aware that they have a right to compensation, whilst many others, understandably, are afraid of bringing a claim and how it might affect them and those around them.”</p>
<p>The cases are often historical in nature and raise complex issues.  However, despite being outside the normal time limits for compensation claims, cases can still be pursued and compensation awards can be recovered for survivors of abuse.</p>
<p>Helen added: “It is important that these cases are investigated and pursued as soon as possible.  I believe it is important to provide not only legal advice and assistance but also support throughout the whole process.  If you or someone you know has or is being affected by abuse or neglect, then it is important to speak to someone who has experience in this area of law.”</p>
<p>Helen joined Tilly Bailey &amp; Irvine Solicitors in 2003, and has since worked in the Personal Injury and Clinical Negligence departments.  She has undertaken research and training to enable her to look after abuse and neglect victims, and help survivors pursue financial compensation to assist in rebuilding their lives.  Helen, who is based in Tilly Bailey &amp; Irvine’s Stockton office, also provides personal injury legal services for a range of cases, from road traffic accidents to Clinical negligence and Industrial disease cases.</p>

				<content:encoded><![CDATA[<p>Whilst the current economic crisis is putting strain on all companies, one of the region’s leading family lawyers is recommending that business owners seek appropriate advice should they feel that divorce is adding to the business’s risks.</p>
<p>Victoria Moreton, partner and specialist in family law with Tilly Bailey &amp; Irvine Solicitors, comments: “Divorce is a sad and often stressful event. However, should one or both parties run a business, the worry can be felt by a wider of circle of people. Employees might fear for their jobs or, if the business is family-owned, relatives might add to the pressure if they feel their livelihoods are at risk too.”</p>
<p>Ms Moreton recommends seeking legal support from a firm with experience in all the relevant fields. Alongside family law, there may be the need for expertise in corporate or commercial property law. In the case of farms, an expertise in agricultural law would also be beneficial.</p>
<p>She adds: “In some situations, a business owner who is divorcing can worry about being financially penalised if the business goes from strength to strength during the period of separation. Alternatively, they might fear criticism if it is less successful at this time.”</p>
<p>Ms Moreton says ensuring the business remains intact is a vitally important part of the divorce process. Often one person is required to resign and sell shares in a business, and complications can arise with family businesses where arrangements have been ‘by understanding’ rather than formerly in writing.</p>
<p>Ms Moreton concludes: “You must feel that you can turn to your lawyer with any query, no matter how large or small, and that the lawyer can tap into all the expertise required by you.</p>
<p>“In my 19 years working in family law, I have represented clients with significant incomes and capital, and with their own businesses including farms. The responsibility of the business can compound the feelings experienced – not only sadness, and worry, but often frustration or anger. The lawyer’s job is to support and advise throughout the process, with understanding of all the elements that could be affected by a divorce.”</p>

				<content:encoded><![CDATA[<p>A local solicitor has joined Tilly Bailey &amp; Irvine Solicitors’ Wills and Probate team, having attained her legal qualifications whilst combining working in legal practice full time with studying and family life.</p>
<p>Nicola Dalzell has specialised in wills and probate for seven years, and brings extensive experience in high value estates with complex issues.  Her new role includes inheritance tax planning, wills, estates and trusts as well as Court of Protection and mental capacity matters.</p>
<p>Nicola completed her qualifications whilst working full time in a legal practice.  Since 2002 she has worked full time in the legal profession, commencing her studies alongside her work in 2004.  In 2007 she qualified as a Fellow of the Institute of Legal Executives.  She then completed her Legal Practice Course between 2009 and 2011, qualifying as a solicitor in September 2011.</p>
<p>Nicola commented: “I set myself the challenge of studying whilst working as a full time lawyer.  I gained specialist knowledge and experience whilst qualifying as a Chartered Legal Executive and later as a solicitor.  I was delighted to be invited to join the Tilly Bailey &amp; Irvine team – my hard work paid off!  This is a leading law firm with a strong probate team.  We all share the same goal which is to provide our clients with a quality, professional service with a personal touch.  My new role allows me much broader experience and an opportunity to develop my career further.”</p>

				<content:encoded><![CDATA[<p>Whilst the recession may be blamed for higher divorce rates in recent years, one local solicitor says that it cannot be responsible for a rising divorce rate in the over-60s.</p>
<p>Such is the rise of divorce in this age range that it has now been labelled ‘silver separations’.</p>
<p>Brian Farrell, solicitor and specialist in family law with Tilly Bailey &amp; Irvine Solicitors, commented: “The upturn in the divorce rate hit the news late last year.  However, the divorce rate in the over-60s had risen a year earlier and was up again in 2010.  This has surprised many but people in their 60s and 70s do not consider themselves old, and some are choosing a different future.”</p>
<p>Mr Farrell said that a number of reasons could be responsible.  People are living longer and are more active.  Couples who have ‘grown apart’ might opt for a new direction and new experiences at this stage in life.  However, the issues for couples divorcing in their 60s and 70s can be complicated and require specialist expertise.</p>
<p>Mr Farrell added: “Each case is individual and should be treated as such – we are fully aware that divorce at any age is often sad and can have serious consequences.  Whilst children are likely to be grown up, property, pensions and inheritance are likely to be high on the list of priorities in such cases.  There are more options opening up for divorce in England and Wales, which can make the process less stressful, or potentially keep the entire proceedings out of the court.  It is important to seek professional advice which takes into account fully the individual circumstances.”</p>

				<content:encoded><![CDATA[<p>Christmas is well known as a time when couples get together but equally large numbers split up too.</p>
<p>The ongoing economic crisis is also affecting many areas of our lives and, according to the Office of National Statistics, has most likely played a part in the rise in divorce rates in England and Wales.</p>
<p>We tend to have a romantic view of Christmas as an opportunity to get together as families but we all know that few survive the break without an argument or two. If the couple are already fractious they may make an extra effort but the stress of &#8220;putting a face on&#8221; Christmas can lead to the ultimate break down of a relationship before the tinsel and tree leave the house. It’s not therefore surprising that Christmas leads some to seriously consider a new start in the New Year.</p>
<p>The Office of National Statistics also reported that ‘divorce rates had increased recently.’ They state that ‘this could be consistent with the theory that recession is associated with an increased risk of divorce, but with a delayed impact.’</p>
<p>Victoria Moreton, partner with Tilly Bailey &amp; Irvine Solicitors and specialist in family law, comments: “Many couples considering divorce during an economic downturn will opt to stay together a while longer, hoping the value of their assets will recover thus allowing them a more valuable pot to split. However, the current situation is much more bleak than we believed a couple of years ago, with little or no economic growth expected in the next few years. This is likely to result in couples deciding to go ahead with the break up now, rather than waiting for a recovery which could be any number of years away.</p>
<p>Victoria adds: “The breakup of a relationship is a very difficult time, especially if there are children involved. However, it is advisable to finalise any financial issues sooner rather than later, allowing both parties to move on with their lives, and avoiding such bombshells as a claim on a property many years later.</p>
<p>“There are options available to couples who are separating which can make the process less stressful and quicker, potentially avoiding the cost and pressure of court proceedings. Once the decision has been taken to break up a relationship, the next step should be to seek professional advice about the options available.”</p>

				<content:encoded><![CDATA[<p>Stockton lawyer Tim Wilsdon has announced his retirement from Tilly Bailey &amp; Irvine Solicitors, one of the region&#8217;s largest law firms.</p>
<p>Tim specialised in a wide range of personal injury cases and was a member of the Law Society&#8217;s Personal Injury Panel. He dealt with Road Traffic Accidents, Accidents at Work, Slips and Trips, Clinical Negligence, Asbestos and other Industrial Disease Claims.</p>
<p>He qualified as a solicitor in 1978 after graduating from Leicester University and trained with Bolsover Manning &amp; Scott in Stockton where he rose to partner. He subsequently joined Tilly Bailey &amp; Irvine Solicitors as a partner following their acquisition of the well-established Stockton practice in 1995.</p>
<p>Tim, 58, who lives in Thimbleby, North Yorkshire, was not only a highly regarded lawyer, rating five stars in the ‘Good Lawyer Guide’, an independent guide to solicitors in England and Wales. He was also a very keen tennis player &#8211; and equally at home at the tennis or law court.</p>
<p>John Hall, Managing partner of Tilly Bailey &amp; Irvine Solicitors, acknowledged the contribution Tim has made to the success of the firm. He commented: “Tim has helped establish Tilly Bailey &amp; Irvine Solicitors in Stockton and we will continue to build on his good work. His friendly and caring manner is precisely the approach we offer all clients. He set the tone and style of our client care in Stockton. Tim was a natural.</p>
<p>“On behalf of all the team at Tilly Bailey &amp; Irvine Solicitors, we wish Tim a long and very happy retirement and we expect to stay in touch &#8211; he is more than a business partner, he is a good friend to many of us at the firm.”</p>
<p>Tim retired from the practice as of 31st December 2011. Personal Injury lawyer Helen Elstob is now handling Tim&#8217;s caseload and growing the business in Stockton alongside partners Martin Brown and Victoria Moreton.</p>

A call by MPs to demand action on spiralling whiplash claims has highlighted the practice of insurance companies selling car accident claimants’ details to third parties, with the aim of all parties making money. This has prompted one national newspaper to describe it as a ‘£2bn racket turning us into a nation of fraudsters’.</p>
<p>However, solicitors from one local law firm that handles personal injury claims say that most solicitors are not benefiting in this way and are not ‘aiding and abetting mass fraud’. John Hall of Tilly Bailey &amp; Irvine Solicitors says they are highly regulated and those who bend or break the rules get prosecuted. He emphasised the importance of ethical personal injury lawyers who represent clients who have suffered loss of income or psychological problems following a road traffic accident which was not their fault.</p>
<p>John Hall, managing partner with Tilly Bailey &amp; Irvine Solicitors who has more than 30 years’ experience in this field, said: “It’s all too easy to label all solicitors and insurers as fraudsters who are fuelling a rapid increase in whiplash claims for their own benefit. However, it is vital to understand the importance of having a good local solicitor to turn to, one with proven expertise, if a car accident leaves you unable to live or earn as you did previously.</p>
<p>“The legal profession in the UK is one to be proud of. It is highly regulated, with lawyers working throughout their careers to further develop their skills, abilities and knowledge to serve their clients better. <p>Julie Clayton, 51, of Hartlepool, was left disabled and unable to work following a car accident in 2007. With help from Tilly Bailey &amp; Irvine Solicitors, she has successfully claimed for compensation. Julie commented: “Tilly Bailey &amp; Irvine Solicitors looked after me through the whole claim process, from visiting me in hospital shortly after the accident to keeping me fully informed at all times. A claim like this can take a long time, and Tilly Bailey &amp; Irvine Solicitors were here to ‘hold my hand’ throughout and secure me appropriate compensation for an accident that has completely changed how I can live my life.”</p>

This is not offering the consumer ‘best value’ or in a lot of cases the best advice. We represent genuine cases, and we work hard to get appropriate compensation for our clients. <p>In January 2012, the Transport Select Committee of MPs said that motor insurance injury claims have risen by 70% in the past six years, despite a 23% drop in the number of casualties actually caused by accidents. Whiplash accounts for 70% of all these claims. The committee said that claimants need to provide much more proof of a whiplash injury. It also stated that insurers should be banned from selling any customer information to third parties – insurance companies can currently receive referral fees for selling claimants’ details to personal injury claims companies, garages, car hire companies and more.</p>

<p>Tilly Bailey &amp; Irvine Solicitors and Greig Cavey Commercial Agents have worked together to deliver the best outcome for all parties &#8211; and secure the future of West Hartlepool Rovers Amateur Quoits Club.</p>
<p>On Tuesday, December 6th, 2011, West Hartlepool Rovers Quoits Club officially launched its new club on Easington Road, having relocated from its previous Grainger Street premises following a proposed compulsory purchase order.</p>
<p>Alan Robinson, official of the Quoits Club, commented: “The compulsory purchase order was a bolt from the blue, and we felt we needed to fight it. However, with excellent support from Tilly Bailey &amp; Irvine Solicitors and Greig Cavey Commercial Agents we’ve been able to work with the council. We now have a fantastic new club.”</p>
<p>Tilly Bailey &amp; Irvine Solicitors agreed and completed the sale of the Grainger Street premises and the purchase of the new premises on Easington Road, and advised on a number of legal issues in relation to its refurbishment and fit out, working closely throughout with Peter Cavey of Greig Cavey Commercial Agents of Hartlepool.</p>
<p>Andrew Beattie, commercial property specialist with Tilly Bailey &amp; Irvine Solicitors said: “It was a shock to the club when they received notification of the compulsory purchase order. They were worried they would have little chance of survival. However, over the last few months we have worked with the club and the Hartlepool Borough Council in order to help them relocate to newly refurbished premises. The club’s new premises have been fitted out to their specification and will be here to serve the community long into the future.”</p>
<p>John Ellwood, partner with Tilly Bailey &amp; Irvine Solicitors and one of the region’s leading licensing lawyers, secured the license for the new property. He added: “In addition to other legal matters the Quoits Club needed a license for its new premises. As always we moved swiftly with the application and secured the license to help progress with the successful relocation.”</p>
