Failed Sterilisation

When a sterilisation operation has not been successful it can often be too late to deal with the consequences of an unwanted pregnancy. If a birth occurs which would not have happened had the original sterilisation procedure been successful, it is known as a "wrongful birth".

Both men and women can claim compensation if the procedure or advice was negligent and resulted in a wrongful birth. The most common claims are as a result of the negligent advice given regarding contraception after the sterilisation procedure.
