  1. Personal injury claims and the law that governs them are complicated

Julius Caesar once said that experience is the teacher of all things, by which he meant that there is no substitute for experience.It may seem straightforward that you have been injured and you deserve to be compensated for that injury, but the law is much more complicated and nuanced than that.It is necessary to establish that the person you blame for your injury was in fact at fault and that the fault amounted to negligence, which is a legal test and is not as simple as it at first appears.It is also necessary to establish that the negligence of the person at fault for your injuries caused those injuries, which can be extremely hard to prove when you have existing conditions or injuries and the Court will require independent medico-legal evidence to establish this fact.You also need to be able to prove that your injury was “more than merely trifling”, i.e. that your injuries were serious enough that they will attract an award of compensation.Again this may seem straightforward enough but some claims are worth very little and some are worth thousands of pounds.Knowing the difference takes experience and knowledge.

No win no fee is exactly what it sounds like – if you don’t win your claim, you don’t pay us a penny.If you go it alone, however, you’ll bear all of the financial burden that we would otherwise take on for you.

Claims are expensive – there are Court fees, expert fees, barrister’s fees, the financial cost of making calls and sending letters not to mention the time it is going to cost you to get all of this done.With a Conditional Fee Agreement (CFA), regulated by the Law Society, we take on all of those costs for you and if you don’t win then there is nothing to pay.If your claim is successful then we recover most of our costs from your opponent or their insurance company.We do take a small fee, known as a success fee, from your damages if you win your case but this is capped at 25% of your damages and we cannot take any more than that.This is to cover any shortfall in costs between what we have actually incurred and what we eventually recover from your opponent (which is usually much less than what it costs us to actually win your claim).So you will always walk away with 75% of your damages.If you decide to go it alone you will be responsible for 100% of the cost of bringing the claim, which can end up being thousands of pounds.
