The Ticking Timebomb Of Asbestos Claims

Our firm has dealt with hundreds of asbestos related disease claims made by clients against factory owners and shipbuilders over the last 20 years. The deadliest disease is Mesothelioma for which condition there is currently no known cure.
According to the British Medical Journal the UK is on the verge of an asbestos related disease epidemic which is likely to peak in about 2020. Recently, local newspaper, the Hartlepool Mail, reported that:
“The town’s MP is calling for more research to be done as it’s revealed Hartlepool has the fifth highest asbestos-related death rate.”
“Figures show that per 8.7 per 100,000 of the town’s population are dying from mesothelioma.”
The latency period between asbestos exposure and the contraction of an asbestos related injury is very long and can often be between 25 and 50 years. Most of the cases with which our firm has been involved relate to exposures to asbestos in the 1960’s and 1970’s. Most of our clients have worked in heavy industry and were not provided with any safety equipment to protect them against being exposed to asbestos dust.
Recently we have been coming across cases involving white collar workers such as teachers and office workers who have contracted Mesothelioma. These workers had not previously been considered to be at risk of contracting the disease but it would seem that even low level exposure to asbestos dust is sufficient to cause someone to contract the disease.
The reason for the disease affecting white collar workers is that many of the schools and offices built after the war contained asbestos products which have not yet been removed. This has meant that large numbers of people have been exposed to low levels of asbestos dust exposure unknowingly for many years.
Unfortunately the case law in relation to these claims is inconsistent and it can be difficult to substantiate a claim against the owners of the buildings and/or local authorities. However what is clear is that these types of cases are likely to increase over the next few years.
