Will Anyone Help When Your Personal Injury Claim Isn't An Easy Win?

When you visit a restaurant, your expectation is an enjoyable meal … and then life goes on.  If you decide to ride a funfair ride, or visit a theme park, you want to go home exhilarated and maybe exhausted, but certainly not injured.  Equally, if you stay in a hotel, you’re booking in for a clean and comfortable bed for the night.

On virtually every occasion what you expect is exactly what happens.  Your meal is enjoyed, your day at the theme park never lasts as long as the kids want it to and your night away in a hotel is relaxing – if you so wish.  However, there are occasions when that’s not the case.

In recent months, Tilly Bailey & Irvine Solicitors has secured compensation for a family whose child was injured on an uninsured fairground ride.  The firm has represented ten Claimants who suffered food poisoning after visiting a new pub and also obtained substantial compensation for a group who ended up in bed with bed bugs when they stayed in a London hotel.  The problems were exacerbated when those bed bugs travelled home with them leading to one lady’s home having to be fumigated.

Theme parks have hit the headlines recently.  However, theme parks are professionally run and will operate with appropriate insurance.  The same cannot always be guaranteed of the type of fun fair ride that pops up for a few days at carnivals and events.  It’s all too easy for the company operating the ride to disappear into administration if they receive a claim, meaning the Claimant has no one from whom to seek compensation.

Mark added: “We recently represented a family whose child fractured an arm on a large inflatable slide, an extra attraction at a local event.  The company running the slide had little or no insurance and went into liquidation, but we didn’t walk away from the claim.  Instead we pursued all legal options, and were successful in securing 90 percent of the value of the compensation claim.”
Another group of Tilly Bailey & Irvine’s clients booked a night in a hotel near Kings Cross, only to find they were sharing their beds with bed bugs, a fact which didn’t appear to bother the hotel staff.  For the visitors however, it didn’t mean just one bad night’s sleep and bites that could be treated.  Bed bugs have a habit of hiding in fabric, and these came home with one client, leading to the fumigation of her home and significant physical suffering.
Mark continues: “The hotel was determined to deny any liability.  It certainly wasn’t the easiest of cases, but we found a way of presenting proof that the hotel was the source of the bed bugs, securing in excess of £10,000 compensation for the Client”.
The number of companies offering to secure compensation for claims has burgeoned in recent years, but Tilly Bailey & Irvine Solicitors has been providing this service for decades.
