Professional Negligence

If you or your business have suffered a loss of money or opportunity as a result of the actions (or omissions) of a professional service provider then we will be able to provide cost-effective, timely advice that will enable you to make your claim cost-effectively and in a managed way that enables you to assess prospects of success and to weigh settlement offers.

If a professional service provider has let you down, causing you or your business to suffer a financial loss or a lost opportunity, then it is important that you act without avoidable delay. There are statutory time limits within which such claims can be brought, and in some cases, it is necessary to act quickly to preserve evidence that you may need to prove your claim in court.

Post-business Sale Disputes

Post-business Sale Disputes

Many agreements for the transfer of a business to new owners contain rights and obligations that come into effect in the months and years after the sale.

If you are involved in a dispute relating to a business sale, or if you would like to be prepared for any disputes that may be on the horizon, then please call a member of the Commercial Disputes and Employment team today.

Debt Claims

Tilly Bailey & Irvine can offer advice and assistance regarding all aspects of debt recovery and can guide you through the whole process, from sending initial letters before action to the debtors, through to obtaining a Court Judgment and enforcement. We can also negotiate with your debtor to enter into a repayment plan if necessary.

Alternately, you do not have to issue Court proceedings against a debtor to recover the debt. You can go down the insolvency route by issuing a statutory demand and either a bankruptcy petition for an individual debtor or a winding up petition against a company.

Construction and Engineering Disputes

Construction and Engineering Disputes

We are experienced in dealing with all forms of contracts used in construction and engineering projects (NEC, JCT etc) and will guide you through the often-complex process of notifying disputes, claiming (and if necessary disputing) payments, whether on account payment, final account determinations, or retention disputes. If formal process is required, be it adjudication, arbitration, litigation, or alternative dispute resolution (mediation, negotiation, early neutral evaluation and so on), then we will guide you every step of the way.
