What to do if you are in a car accident

If you are involved in a car accident, your first priority should be the health and safety of you and your passengers.  By taking the following steps, you can improve your chances of claiming compensation and ensure your insurance claim runs smoothly:

  1.  If anyone is injured, call an ambulance.
  2. Do not apologise for the accident or accept any blame.
  3. Exchange details with the drivers of any other vehicles involved and witnesses to the accident.
  4. Record any details of the crash, including the time and date, the road conditions, the circumstances of the event, damage to the vehicles and a description of any injuries.  Take photos on your mobile phone if possible.

What type of injuries can I claim for in a road traffic accident?

Being involved in a car crash can cause injuries ranging from minor to catastrophic.  They include:

  • whiplash
  • head and brain injuries
  • spine damage
  • broken bones
  • severe organ damage and internal bleeding

If you or a loved one have suffered from a car crash injury, you may be able to claim compensation.  We will swiftly be able to inform you of your chances of successfully making a claim and the amount of compensation you are likely to receive.

Can you claim for a car accident that was your fault?

If you have received an injury, such as whiplash, after being involved in a car accident that was not your fault, you may be able to claim compensation.

To qualify for compensation, you will need to prove that the driver of the other vehicle, (or vehicle, if you are an injured pedestrian or cyclist), was negligent.  For example, they may have been using their mobile phone when driving, not driving in accordance with the weather or conditions at the time of the accident or they may have been travelling too close to you and rear-shunted your vehicle.

Even if your accident was caused by an uninsured driver or the driver cannot be traced, you could still make a claim via the Motor Insurers’ Bureau (MIB).  These claims can sometimes be more complex, so you’ll need a legal expert with specific experience and an excellent track record in this area; which is exactly what we offer.

How much can you get for a whiplash claim?

Compensation is awarded to enable you to get you back to the same position you were in before an accident.  The courts typically make a financial award dependent on the severity of the whiplash injury, and an amount to cover any out of pocket expenses.

The amount of general damages given for personal injury claims is set by Judicial Studies Board (JSB) guidelines. Special damages quantities are made up of expenses such as

  • Travel expenses
  • Hospital visits and parking
  • Loss of earnings or bonus
  • Rehabilitation cost and prescriptions
  • Additional household costs
  • Help or care while you are recovering

Compensation amounts for minor whiplash range from £1,000 to £2,750.  However, in serious cases, where the victim’s life is severely impacted due to permanent neck and spinal damage sums in excess of £100,000 may be awarded.
